Terms of Use

These Terms of Use ("Terms") govern your use of the CaffIQ mobile app and the caffiq.app website (together, "CaffIQ"). By downloading, accessing, or using CaffIQ, you agree to these Terms. If you do not agree, please do not use CaffIQ.
CaffIQ is developed by Guillaume Brard, an independent developer based in France (the "developer", "we", "us"). Full publisher details are set out in our Legal Notice.
This English version is the reference version. Translations are provided for convenience; if there is any conflict, the English text prevails, without depriving you of the mandatory protections of the law of your country of residence.
CaffIQ is not a medical device and does not provide medical advice. Its estimates and recommendations are informational only and are based on general pharmacokinetic models — they are not a diagnosis, a treatment, or a substitute for professional advice. Do not rely on CaffIQ as the sole basis for any health or safety decision. Always use your own judgement and consult a qualified healthcare professional for any question about caffeine, sleep, pregnancy, medication, or your health.
Eligibility
You must be old enough to form a binding contract in your country, and at least the age required to consent to the processing of personal data where you live. CaffIQ is not intended for children.
License
We grant you a personal, non-transferable, non-exclusive license to use CaffIQ on Apple devices you own or control, in accordance with these Terms and with Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"). Where these Terms and the Apple Standard EULA conflict, the stricter provision that protects you as a consumer applies.
The website
The caffiq.app website is provided for general information about CaffIQ. It is offered "as is", and the intellectual-property and liability provisions of these Terms apply to it.
Subscriptions, trial & billing
CaffIQ is free to download and includes core tracking. CaffIQ Pro unlocks the full experience.
- Free trial: a 7-day free trial may be offered. If you do not cancel before the trial ends, it converts to a paid subscription.
- Plans: CaffIQ Pro is available as an annual or monthly auto-renewing subscription, or as a one-time "Lifetime" purchase.
- Auto-renewal: subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- Billing & management: payment is charged to your Apple Account. You can manage or cancel your subscription at any time in your Apple Account settings. Deleting the app does not cancel a subscription.
- Prices and plan details are shown in the app before purchase and may vary by region.
Purchases, refunds & right of withdrawal
CaffIQ Pro is sold through Apple's App Store. Apple is the seller of record for your purchase, and billing, receipts, refunds, and cancellations are handled by Apple under Apple's terms. We do not process payments and cannot issue refunds directly.
If you are a consumer in the EU/EEA, you may have a statutory right of withdrawal. Because CaffIQ Pro is digital content/services supplied immediately, that right may no longer apply once supply has begun with your prior express consent. Any withdrawal or refund request is made through Apple (for example, via Report a Problem in your Apple Account). This does not affect your mandatory consumer rights.
Acceptable use
You agree to use CaffIQ only for lawful purposes and not to misuse, reverse-engineer, decompile, or attempt to disrupt or gain unauthorized access to the app, except to the extent such restrictions are prohibited by applicable law.
Intellectual property
CaffIQ, including its name, logo, design, and content, is owned by the developer and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
Disclaimer of warranties
To the maximum extent permitted by law, CaffIQ is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or that its estimates will be accurate for every individual. Nothing in this section limits the statutory legal guarantee of conformity or other mandatory rights you have as a consumer.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, CaffIQ. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law — including your mandatory consumer rights.
Changes
We may update the app and these Terms from time to time. The "Last updated" date above reflects the latest version, and we will announce material changes in the app or on the website. Continued use of CaffIQ after changes take effect constitutes acceptance of the updated Terms.
Termination
You may stop using CaffIQ at any time, including by uninstalling the app. We may suspend or end your access if you materially breach these Terms or the law. Sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply after termination.
Governing law & disputes
These Terms are governed by the laws of France, without depriving you of any mandatory consumer-protection rights you have in your country of residence.

Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the app, without reducing your rights. Neither party is liable for failures caused by events beyond its reasonable control.
